Infringement/s (speeding, redlight camera or any other traffic offence) is an area that is confusing for lots of our students. There is a common misconception that majority of people think Driving Schools are responsible for any Traffic offence occur during a driving lesson. Perhaps this post will clarify this confusion.
Drivers are always responsible for any infringement incurs while they are driving, either in their own cars or when they are learning in a Driving school vehicle. The process of receiving the infringement notice is different. When a learner driver or a driver under supervision (licence holder, who requires further training) is driving in a Driving school vehicle commits a traffic offence, the Driving School will receive the Infringement Notice including a Nomination Form and a pre-paid envelop.
The Driving School will complete the Nomination Form (Nominating the learner driver who was behind the wheel at the time the traffic offence occurred.) The Nomination Form including the Infringement Notice will be posted to the police in the pre-paid envelope provided.
Once this form is returned, the driving school has no further responsibility towards that Infringement Notice. The police will follow up with the Nominated person (who is the learner driver). The learner driver will have to communicate with the police and consequently is responsible for any fine or loss of demerit point incurred.
